Description

Getting Paid is a convenient and readable guide to help in dealing with the difficulties in fee recovery, which is a perennial and destructive issue in contemporary architectural practice. Until recently, architects faced a triple whammy when a client did not pay: first, cash flow was cripplingly disrupted; second, action in law was prohibitively expensive and risky; and third, the defendant client could demand that the architect should provide security for costs. However, recent changes to the way legal actions are conducted make these difficulties considerably easier to overcome. Written by a respected construction lawyer and a practising architect, 'Getting Paid' describes the problems which may face an architects practice in pursuing fee claims and looks at the practical and contractual steps which might be taken to reduce these risks.

About the Author

Stephen Yakeley

Stephen Yakeley founded Yakeley Associates in 1974 which in its 35 years’ existence has designed and built projects with a construction value totalling over £2bn. He was a founding board member and later Vice President of the London chapter of the AIA, a member of the RIBA Practice Committee, President’s Theme Group (to explore RIBA strategy), Procurement Subcommittee, Fees and Appointments Group (which drafted the RIBA Standard Forms of Appointment for an Architect, SFA/99 and CE/99) and the Clients’ Advisory Service Task Force. He was a member of the joint RIBA/BIID committee which drafted ID/05.He has co-authored a book, Getting Paid, for RIBA Publishing and is the author of the Association of Consultant Architects’ (ACA) form of agreement for the appointment of an architect, ACA SFA/08. He currently advises the Council of the ACA on legal and practice matters.
