The issue of whether a construction project has achieved completion has long been the source of many disputes within the construction industry. This isnt surprising, because many of the Standard Forms of Contract rely upon the issue of a Completion Certificate to trigger such matters as the release of the first part of retention, the end of the contractors exposure to Liquidated and Ascertained Damages, and Insurance of the Works. Given the importance of completion, its surprising that the forms, used as standard throughout the construction industry, generally dont provide a definition of completion. Instead, its left to the discretion of the architect, engineer or supervising officer to determine a projects completion.
